Membership and Season Pass Terms and Conditions
These Terms and Conditions apply to all members and season pass holders of Rainbow Sports Club Incorporated (“the Club”). They operate in conjunction with the Club’s Constitution and any bylaws or policies made under it.
1. Relationship to the Constitution
These Terms and Conditions are made under the Constitution of Rainbow Sports Club Incorporated.
In the event of any inconsistency between these Terms and the Constitution, the Constitution shall prevail.
All disciplinary matters, disputes, suspensions, and terminations will be managed in accordance with the dispute resolution and natural justice procedures set out in the Constitution and the Incorporated Societies Act 2022.
2. Definitions
Financial Member means a member who has paid all applicable fees by the due date and has been admitted to membership of the Club in accordance with the Constitution.
Season Pass means a pass issued by the Club that provides skiing or riding access during a defined operating season. A season pass holder is also a financial member.
Committee means the governing body of the Club.
3. Membership Validity
Membership is personal to the named member and is not transferable.
Membership is valid only while the applicable membership fee has been paid in full.
Membership does not automatically include a Season Pass unless explicitly stated by the Club.
Proof of membership may be required at any time when accessing Club facilities, benefits, or activities.
4. Financial Year and Membership Period
The Club’s financial year runs from 1 December to 30 November.
Membership is issued and administered in alignment with the financial year unless otherwise determined by the Committee.
Membership rights, benefits, and voting eligibility apply only while a member is considered financial.
The Committee may set, vary, or prorate membership fees and membership periods as permitted under the Constitution.
5. Season Pass Validity and Use
A Season Pass provides access to ski or ride at the Rainbow Ski Area during the operating season, subject to weather, snow conditions, safety requirements, and operational constraints.
Season Passes are valid only for the season for which they are issued and do not carry over unless expressly approved by the Committee.
Season Passes are personal to the named holder and are not transferable.
The Club does not guarantee a minimum number of operating days in any season.
6. Operating Days
The Rainbow Ski Area’s standard operating days during the season are Saturdays and Sundays.
Additional midweek operating days may be offered at the Club’s discretion
The Rainbow Ski Area may be closed or have limited operations due to:
Weather or snow conditions
Safety concerns
Natural events
Mechanical issues
Public health measures
Any other circumstance beyond the Club’s reasonable control
The Club endeavours to operate as many days as reasonably practicable but makes no guarantee of continuous or uninterrupted access.
7. Membership and Season Pass Fees
Membership fees and Season Pass fees are set by resolution of the Committee.
All fees must be paid in full by the due date unless otherwise approved by the Committee.
Payment processing or transaction fees may apply and are non-refundable.
8. Refunds, Transfers, and Deferrals
Membership
Membership fees are generally non-refundable, except where the Committee determines that exceptional circumstances apply (for example, medical or hardship reasons).
Requests must be made in writing and include supporting documentation.
Season Passes
Season Passes are non-refundable once the season has commenced.
Prior to the commencement of the season, the Committee may consider refunds, transfers, or deferrals in exceptional circumstances, at its sole discretion.
A perceived lack of snow, reduced operating days, or personal availability are not valid grounds for refunds or transfers once the season is underway.
Approved refunds or transfers may incur an administration fee.
9. Membership Cards and Pass Media
Members and Season Pass holders must carry and display their membership card or pass when requested.
Lost or stolen cards or passes must be reported to the Club as soon as reasonably practicable.
Replacement cards or passes may be issued at the discretion of the Committee and may incur an administration fee.
10. Reciprocal Benefits
Members and Season Pass holders may be eligible for reciprocal benefits at affiliated ski fields or clubs.
Reciprocal benefits are offered at the discretion of the hosting organisation and are not guaranteed by the Club.
Reciprocal benefits are available only during periods when the Club is operating and the holder is financial.
11. Conduct and Conditions of Use
All members and Season Pass holders must:
Comply with the Snow Users’ Responsibility Code.
Follow all posted signage and reasonable instructions from Club staff and volunteers.
Conduct themselves in a manner that promotes safety, respect, and the reputation of the Club.
Misconduct includes, but is not limited to:
Unsafe, reckless, or antisocial behaviour
Fraudulent or unauthorised use of a membership or Season Pass
Providing false or misleading information
Failure to comply with Club rules, bylaws, or instructions
12. Suspension or Termination
The Committee may suspend or terminate membership or Season Pass privileges where these Terms, the Constitution, or Club policies are breached.
Any suspension or termination will follow the dispute resolution and natural justice processes set out in the Constitution.
Suspension or termination does not entitle the holder to any refund.
13. Commercial Use
Memberships and Season Passes must not be used for any commercial purpose without prior written approval from the Committee.
14. Risk and Assumption of Liability
Members and Season Pass holders acknowledge that skiing, snowboarding, and other snow sports are inherently hazardous.
Hazards may be natural or man-made and may be marked or unmarked.
Participation is entirely at the individual’s own risk, to the fullest extent permitted by law.
The Club is not responsible for loss, damage, or injury except where liability cannot be excluded by law.
15. Voting Rights
Financial members may attend and vote at general meetings in accordance with the Constitution.
